Costa Coffee has been voted the ‘UK’s Favourite’ coffee shop for the ninth year in a row by Allegra’s independent panel of consumers. The question ‘What is your favourite coffee shop?’ was asked of an independent panel of 3,065 coffee shop visitors, with 51% citing Costa Coffee as their preferred café.

Costa Coffee Club Membership Rules

These Terms and Conditions (“T&C”) together with the Costa Coffee Club Privacy Policy (“Privacy Policy”) of Costa Coffee Club application (“App”) (“Membership Rules”) govern the Costa Coffee Club Membership (“Membership”) of all its members (“Member” or “you”) in the State of Kuwait (the “Territory”).  The Membership is owned and operated by Alghanim International for Light Food and Refreshments Co. S.P.C. (“AILFR”) or any of its affiliates and subsidiaries, or any entities part of Alghanim Industries group of companies (together with AILFR, “Alghanim Industries”, “we” or “us”).  Using your Costa Coffee Club App or any of your Membership benefits will constitute acceptance by you of the Membership Rules.

  1. Becoming a Member

You can become a Member by downloading and registering on the App. Your Membership enables you to earn beans and to redeem those beans on all items in Costa outlets except merchandise (the “Beans”) in the Territory.  You can use your App at any participating Costa outlets. Your use of the App is subject at all times to these Membership Rules.  

Your Membership can only be registered in the name of an individual, cell phone number and/or email address; and only one Membership may be registered in such name, cell phone number and/or email address. 

  1. Earning and Redeeming Beans

Beans can only be earned at the time of purchase. In order to earn at the time of purchase or to redeem your Beans, you have to scan QR Code on your App at the point of purchase.  You will be granted a hundred (100) Beans upon downloading the App; and another hundred (100) Beans when you complete your profile information. You can check the Beans balance of your Membership by checking the App.

Beans have no cash value and cannot be transferred to any other person.  Redeemed beans cannot be used again.  Beans can only be earned, held and redeemed as set out in these Membership Rules.

Beans are personal to the individual Member and cannot be pooled with Beans earned by another Member and redeemed together.

You may start redeeming your Beans at the following purchase of owning them.  Each hundred (100) Beans has a value of one (1) Kuwaiti Dinars when redeemed against a purchase.  You must have sufficient Beans to pay in full for an item purchase with such Beans if you wish to redeem Beans in connection with such purchase.  You may not make part payment for a purchase using redeemed Beans.  Beans cannot be earned when a purchase is made with redeemed Beans.

There are two tiers of Membership:

Red Tier

Members of the Red Tier will earn one (1) Bean for each hundred (100) Kuwaiti Fils spent.  There are no fractional bean earnings, and any amount spent under a hundred (100) Kuwaiti Fils or not in multiple of a hundred (100) Kuwaiti Fils shall not earn any Beans or partial Beans.  Your Beans are valid for six (6) months from the date you earn them.

Gold Tier

Members of the Gold Tier will earn 20% more Beans than Red Tier Members with each purchase. There are no fractional bean earnings, and the beans earned are always rounded down whole numbers.  Your Beans are valid for twelve (12) months from the date you earn them.

A Red Tier Member becomes a Gold Tier Member when they spend (i) one hundred twenty five (125) Kuwaiti Dinars in the first ninety (90) days of becoming a Member and (ii) four hundreds (400) Kuwaiti Dinars in any twelve (12) consecutive months. 

A Gold Tier Member can maintain his Gold Tier Membership by earning four thousands (4000) Beans every twelve (12) consecutive months.  If a Gold Tier Member does not maintain his status, they go back to being a Red Tier Member.

  1. Expiry and Cancellation

Your Membership does not have an expiry date. However, your Beans are only valid so long as you have used your App to earn and/or redeem Beans in the past six (6) months. If your Membership has not been used in this way for 6 consecutive months we reserve the right to permanently remove Beans from the balance on your App.  Expired Beans cannot be transferred to a new App or redeemed or restored. 

You have the right to cancel your Membership by deleting the App at any time. If you cancel your Membership, you will lose the right to redeem all Beans that are unused at the time of cancellation.

We may cancel all accrued Beans, and/or suspend your right to collect and/or redeem Beans if we have grounds to suspect that you are engaged in fraudulent or other criminal activities relating to us, or the App, or if you supply false or misleading information to us or are in any other way in breach of the Membership Rules.

  1. Loss, theft, damage

You should treat your Beans like cash in a wallet. You are solely responsible of maintaining the access to your App.  You undertake to inform us of any loss and theft of your, or any unauthorized use of your Membership.  

We reserve the right to determine, solely at our discretion, your eligibility of a replacement and/or transferring your Beans or re-crediting your Beans that were redeemed without your consent.

  1. Variation

We reserve the right to amend or waive any provision of these Membership Rules and the App at any time, or to terminate the Costa Coffee Club program (and therefore your Membership). This right includes, but not limited to, changes in entity who operates the Costa Coffee Club, rules for earning and redeeming Beans and any promotional offers. Changes we make are binding on you from the date that we make them.

  1. Assignment

We may transfer the benefit of these Membership Rules to any other party.

  1. Data Protection and Privacy

While registering to become a Member through the App, you will be asked to provide voluntarily certain personal information, including your name, address, contact details and other personal information (the “Personal Data”).  We are committed to maintain the security of your Personal Data against unauthorized access, loss, disclosure or destruction in accordance with the requirements of the applicable data protection laws and regulations in the State of Kuwait.

The purposes of the collecting and usage of your Personal Data are governed by these Membership Rules and subject to our Privacy Policy.

  1. Disclaimer, Liability and Indemnity

We make no representation or warranties about the accuracy, completeness, timeliness, reliability or non-infringement of any content on the App or services available through it.  We are not liable for any damages or harm attributable to the App, or your enrolment in the Membership. 

In no event shall we be liable to you or to any third party for any direct, incidental, indirect, special or consequential damages whatsoever (including, but not limited to, loss of profits, business interruption, loss of programs on your information system) arising out of or related to: (i) your use of or reliance on the  App or any information, hyperlinks or content contained therein; (ii) your provision of information, personal or otherwise to us; (iii) any default, delays, omissions, interruptions and inaccuracies resulting directly or indirectly from any cause, including but not limited to, failure of network services; or (iv) our acts or negligence or any of our agents or employees. 

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAWS, AILFR DISCLAIMS AND EXCLUDES ALL WARRANTIES AND REPRESENTATIONS, EXPRESS, IMPLIED OR STATUTORY, WITH RESPECT TO THE APP OR AS A RESULT OF YOUR ENROLMENT IN MEMBERSHIP, OR WITH RESPECT TO THE ACCURACY, CURRENCY OR COMPLETENESS OF THE INFORMATION PROVIDED BY AILFR, INCLUDING THE IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF A PATENT, TRADEMARK OR OTHER INTELLECTUAL PROPERTY RIGHT.  THE APP, INCLUDING, WITHOUT LIMITATION, ALL CONTENT, INFORMATION AND LINKS CONTAINED THEREIN, IS PROVIDED "AS-IS" WITHOUT ANY WARRANTY THAT IT WILL BE UNINTERRUPTED OR ERROR-FREE.  THIS EXCLUSION OF LIABILITY APPLIES TO ALL CAUSES OF ACTIONS, WHETHER BASED ON CONTRACT, WARRANTY, TORT OR ANY OTHER LEGAL THEORIES.

You agree to indemnify AILFR, its employees, agents, affiliates and its shareholder and to hold them harmless from and against any and all claims and liabilities (including attorney’s fees and out-of-pocket expenses) that may arise from your use of the App.

Any links contained on the App are provided by us merely as a convenience to you of the App, and we are not responsible for the content or operation of any such linked sites.  Any links to such linked sites should not at any time be construed as an endorsement, representation (s) or promotion by us as to the content, representations, accuracy, products or services found or otherwise described in such linked sites.  The usage of these linked sites is done at your own risk.

  1. Intellectual Property 

The App and all of its content including but not limited to all text, graphics and html codes, all product names, trade names, service names, domain names, tag lines, or logotype distinguished in form, text, or otherwise from surrounding text are copyright materials that owned by or licensed to AILFR and may not be printed, copied, posted, reproduced, used (including photos of faces) or otherwise distributed in whole or in part, without AILFR prior written approval.  

  1. Governing law

These Membership Rules shall be governed by the laws of the State of Kuwait, Any dispute or claim arising out of or in connection with these Membership Rules or its formation (including non-contractual disputes or claims) shall be addressed to the competent courts of the State of Kuwait.
